1. Agreement to Terms

By accessing or using the Elevate Indoor Golf website, mobile application, or services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms apply to all visitors, users, and others who access or use our Services, including those who subscribe to our SMS or email communications.

2. Use of Services

2.1 Eligibility

You must be at least 18 years old to make bookings or enter into agreements with Elevate Indoor Golf. Minors may use our facilities only with adult supervision and consent.

2.2 Account Registration

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 Prohibited Uses

You agree not to:

  • Use our Services for any illegal purpose or in violation of any local, state, or federal regulations
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the Services or servers
  • Transmit any viruses, malware, or other malicious code
  • Harass, abuse, or harm other users or staff members
  • Impersonate any person or entity or falsely state your affiliation with a person or entity

3. SMS Communication Terms

3.1 SMS Program

By opting in to receive SMS messages from Elevate Indoor Golf, you consent to receive text messages for transactional purposes (booking confirmations, reminders, account updates) and marketing purposes (promotions, special offers, news) at the phone number you provided.

3.2 Message Frequency

Message frequency varies depending on your bookings and promotional activity. Transactional messages are sent as needed for your bookings. Marketing messages may be sent periodically, typically no more than 4-6 times per month.

3.3 Message and Data Rates

Standard message and data rates may apply based on your mobile carrier's plan. Please contact your mobile carrier for details about your plan.

3.4 Opt-Out Instructions

You can opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive one final confirmation message. You may continue to receive transactional messages related to existing bookings.

3.6 Carrier Compatibility

SMS messages are supported by major carriers including AT&T, T-Mobile, Verizon, Sprint, and others. Carrier fees may apply. We are not liable for any delays or undelivered messages.

4. Bookings and Payments

4.1 Booking Policy

All bookings are subject to availability. By making a booking, you agree to arrive on time and adhere to your reserved time slot. Late arrivals may result in reduced session time without refund.

4.2 Cancellation Policy

Cancellations must be made at least 24 hours in advance for a full refund. Cancellations made less than 24 hours before your booking may be subject to cancellation fees. No-shows will be charged the full booking amount.

4.3 Payment

Payment is required at the time of booking. We accept major credit cards and debit cards. All prices are in Canadian dollars (CAD) and include applicable taxes unless otherwise stated.

5. Liability and Assumption of Risk

Golf and simulator activities carry inherent risks. By using our facilities, you acknowledge these risks and agree to our liability waiver. You are responsible for any injuries or damages you cause to yourself, others, or our property.

Elevate Indoor Golf is not liable for any injuries, accidents, loss, or damage to personal property that may occur on our premises, except where prohibited by law.

6. Intellectual Property

All content on our Services, including text, graphics, logos, images, software, and other materials, is the property of Elevate Indoor Golf or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Elevate Indoor Golf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or related to your use of our Services.

Our total liability to you for any claims arising from your use of our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta.
